Discrimination & Bias

AI inherits the biases of whatever data it was trained on. When the AI you bought is making hiring, lending, or service-routing decisions — your business owns the outcome, regardless of which vendor's logo is on the box.

Why This Matters

AI systems can perpetuate or amplify biases present in their training data, leading to discriminatory outcomes in hiring, lending, and customer service. The catch: businesses have legal liability under existing civil rights laws — Title VII, ECOA, the FHA — even when the discrimination comes from an AI tool that the business merely licensed.

Federal regulators have made it explicit: "the algorithm did it" is not a legal defense. In Mobley v. Workday (N.D. Cal., 2025), the court held the AI vendor itself "participates in the decision-making process" — and Workday's own filings acknowledged that 1.1 billion applications had been rejected by its AI tools since 2020. The CFPB and EEOC continue to apply existing civil rights laws to AI-driven decisions; NYC, Colorado, and Illinois have all passed AI hiring audit laws of their own.
